ResonantVibe LLC — Limited Warranty (VAVE Systems)

1. Who this warranty is from, and who it covers

ResonantVibe LLC, 42 W Byers Pl., Denver, Colorado 80223 ("ResonantVibe," "we," "us") provides this Limited Warranty to the original end-user purchaser of a new VAVE System bought from us or an authorized seller.

This is a Limited Warranty as that term is used in the Magnuson-Moss Warranty Act.

2. What is covered, and for how long

Limited Warranty

Five-Year Limited Warranty — structural metal components

Two-Year Limited Warranty — all other components we build or supply

One-Year Limited Warranty — upholstery, foam and cushioning

We warrant to the original end-user purchaser only that your VAVE System will be free from defects in materials and workmanship under normal use, for the periods below, running from the date the System was first delivered to you. This warranty is personal to the original purchaser and does not transfer (see Section 7).

‍

CoverageComponentsPeriod
StructuralAll metal structural components — platform frame, legs, metal end housings and supports5 years
StandardAll other components we build or supply — wood shells and enclosures, transducers, amplifiers, controller and computing hardware, power supplies, sensors, wiring, cables, and VAVE-branded accessories including the headrest2 years
Soft surfacesUpholstery, foam, and cushioning — manufacturing defects only (stitching failure, delamination, material flaw)1 year

This version applies to Systems first delivered on or after September 28, 2026. If your System was first delivered before that date, the version of this Limited Warranty in force on the date of your delivery governs, and nothing in this version reduces any period you already hold.

Certified refurbished Systems are sold in the United States only, and only by us or by a seller we have authorized. A certified refurbished System purchased from us or from a seller we have authorized is warranted for one (1) year from delivery on all standard and soft-surface components; structural components carry the remainder of the original five-year structural period, which runs from the System's first delivery to its original purchaser. A refurbished System purchased from any other source carries no ResonantVibe commercial warranty; your statutory rights are unaffected.

Replacement parts are warranted for the remainder of the original applicable period or ninety (90) days, whichever is longer.

A bolster bought after the order is a new purchase. That bolster is warranted on the Standard tier for two (2) years from the date the bolster is delivered to you, whatever the dates of the System the bolster joins.

Where the law of your state gives you a longer period or a right this warranty does not provide, that law controls.

3. What is not covered

This warranty does not cover:

Wear and appearance

  • Normal wear, including compression, softening, or surface wear of upholstery, foam, and cushioning after the one-year defect window
  • Cosmetic damage — scratches, scuffs, fading, dents, or marks — that does not affect function

Handling and environment

  • Damage from misuse, abuse, neglect, accident, or dropping
  • Liquid exposure, submersion, or use in a sauna, steam room, or similarly humid environment
  • Damage arising from moving or relocating the System other than in accordance with the relocation procedure in the Instructions for Use, or by a service provider we have approved
  • Damage from connection to a non-conforming power supply — an ungrounded outlet, incorrect voltage, or unauthorized power infrastructure — or damage caused by the System's built-in surge protection having been defeated or bypassed
  • Damage from unapproved cleaning products

Your System includes built-in surge protection. Damage from an ordinary power surge, where the System was connected to a properly grounded outlet of the correct voltage, is covered.

Modification and service

  • Damage or failure caused by unauthorized repair or modification, or by the opening of sealed enclosures
  • Damage or failure caused by an accessory or component we have not approved

Use outside consumer terms

  • Commercial use. This warranty covers normal residential use. Normal residential use means use by you and members of your household, and occasional use by your personal guests; it does not include making the System available to clients, members, or the public, whether or not for a fee. A System purchased under consumer terms and placed into commercial service is covered instead under our commercial warranty terms, which apply duty-cycle limits and operator requirements. Contact us before placing a System into commercial service so we can convert your coverage.

Not part of the System

  • Software, the VAVE App, the VAVE Hub, and Cloud Services, which are governed by our Terms of Use
  • Third-party accessories, including biosensor headbands and headphones — see §9

How the System sounds

  • The sound the platform makes in the room, or in any neighboring space, as it plays, at any level. A VAVE System is an instrument, and its deck sings: that sound is a designed property of the System, described in The Instrument Sings: Sound Disclosure and Buyer Acknowledgment, which you read before you ordered, and it is not a defect in materials or workmanship. A covered defect that changes how the System sounds, such as a loose part that rattles or a transducer that fails, is covered in the usual way.

Causation, not status (15 U.S.C. §2302(c)). Nothing in these exclusions voids or limits coverage merely because a part, accessory, product or service not supplied or branded by ResonantVibe was used with the System, because work on the System was performed by anyone other than ResonantVibe or a service provider ResonantVibe has approved, or because a sealed assembly has been opened. What is excluded is damage to, or failure of, a covered component caused by that part, accessory, product, service or work — and ResonantVibe bears the burden of showing that causal connection.

4. What we will do

If a covered defect appears during the applicable period, we will, at our option: repair the System, replace the affected component, replace the System with the same or a functionally equivalent model, or refund the purchase price.

Replacement parts and components may be new, refurbished, or functionally equivalent.

5. How service works

Your VAVE System is modular by design. Most components can be replaced without returning the System, and without any need to crate or ship it.

5.1 Start a claim. Contact support@resonantvibe.com with proof of purchase and a description of the issue. We do our best to respond sooner — and in any event we will open a ticket and begin investigating within two (2) business days.

Proof of purchase means any of: your ResonantVibe order number; your invoice or receipt; or your delivery confirmation. For a System whose ownership has changed, the free ownership registration under Section 7 or a serial-number lookup may identify the System — but this warranty is non-transferable and ends at change of ownership (Section 7), and proof of the original purchase remains required for any claim within the original purchaser's coverage. If you cannot locate any of these, contact us with the System's serial number and we will look up its purchase record.

5.2 Diagnosis. We diagnose remotely wherever possible. To do this we may ask you for:

  • Photographs of the affected component and the surrounding installation
  • Video of the fault occurring, where it is intermittent or audible
  • A description of how the System has been used — session frequency and duration, and any transport or relocation
  • Information about the room — flooring, levelness, humidity, and proximity to water
  • Remote diagnostic access to your System, with your consent at the time of each session
  • A video call with a technician
  • On-site access, and reasonable availability for scheduling, where an in-person visit is needed

Requests will be proportionate to the fault. If any of this is not provided, our service timeframes are extended for as long as we are waiting — but your warranty coverage is not affected. If you prefer not to allow remote access, we will arrange a technician instead.

5.3 Replacement parts. Where a part can be replaced on site, we send you the part with guided instructions. Replacement parts ship once you have sent us tracking confirmation that the removed part is on its way back.

Fitting a part yourself is always your choice. If you would rather not, we will arrange a technician at no cost during the warranty period. (Section 5.5 describes the one narrow case in which a technician visit can ever be chargeable — a visit you request that finds no covered defect. A visit arranged under this Section, for a part we have already determined to be faulty, is not that case and is never chargeable.) Any work you carry out yourself is undertaken at your own risk, and we are not responsible for injury or property damage arising from it. Always disconnect the System from the wall outlet before removing any part.

5.4 Components that come to us. Some components — including the controller enclosure — are sealed and are not opened by customers. These are returned to us, serviced, and sent back to you. Where you choose to return a part rather than fit a replacement yourself, we do our best to complete the bench work in three (3) business days — and in any event we ship the serviced or replacement part within five (5) days of receiving it.

5.5 Technician service. Where a technician is needed, service is provided at no cost during the warranty period. There is no geographic exclusion within the territories we serve. Alaska, Hawaii, and US territories are scheduled by arrangement.

Remote diagnosis comes first, and it is free. We offer a free remote session on every claim (§5.2), and it resolves most faults without anyone coming out. The free session covers up to sixty (60) minutes of our technician's time for each fault — and in practice you are very unlikely to ever meet that limit: almost no fault needs an hour of remote time, time spent waiting on you never counts against it, and if your fault turns out to be a defect this warranty covers, remote diagnosis is free however long it takes — the hour never applies to a covered fault. The hour is counted per fault, not per call: if the same fault takes more than one session, is reopened, or is picked up by a second technician, it all draws on the same hour; a genuinely different fault gets its own. In the rare case where a fault that proves not covered needs more than the hour, we will tell you, quote the further remote time in advance at our published Service Rate Schedule rate, and continue only with your written go-ahead — remote time is never quietly continued into a charge. A visit we decide to send is never chargeable to you, whatever the technician finds.

Where you ask us to send a technician. If you ask for a visit, we will tell you whether remote and shipped-part options are exhausted, and we authorize the dispatch in writing where they are. Before that visit is scheduled we will tell you in writing that a no-fault-found fee of $330 under our published Service Rate Schedule — covering the trip and the first hour in territory, with travel zones charged in addition and stated to you before we schedule — may apply if the technician finds no defect covered by this warranty, and we will ask you to confirm in writing that you understand it. No such fee can be charged unless every one of the following is true:

  • the free remote session was completed, or was offered and you chose not to use it;
  • we authorized the dispatch in writing;
  • you acknowledged the fee in writing before the visit was scheduled; and
  • the inspection found no defect covered by this warranty, documented as the Service Rate Schedule requires.

If any one of those is missing, nothing is chargeable. If the technician finds a covered defect, the visit is free — as is everything else the claim needs. And if any repair is authorized during the same visit, the entire fee is credited against that repair: you pay it only where nothing covered is found and no work is done.

This fee applies to purchases in the United States only.

The fee is $330, as published in our Service Rate Schedule: one flat fee, credited in full against any repair authorized from the same visit, with travel zones charged in addition and stated before we schedule.

Nothing in this paragraph applies to a whole-System return under §5.9, or affects any right §11 says cannot be excluded.

5.6 Structural frame. Metal structural components are covered for manufacturing defects only, and require an on-site inspection before we can make a determination. Because these components are fabricated to order, we do our best to complete structural work sooner — and in any event replacement takes no longer than 30 days for standard configurations and 30 to 60 days for custom orders. Where a structural defect cannot be remedied within a reasonable period, we may elect to replace the System or refund the purchase price instead.

5.7 Returned parts. Removed parts must be returned within fifteen (15) days. If a part is not returned, or if inspection shows the failure resulted from something this warranty does not cover, we may invoice you for the part and any associated labor at our published Service Rate Schedule.

5.8 Timeframes. How long service takes depends on the fault, parts availability, shipping, and your availability for scheduling, and may be extended by conditions outside our control. Wherever this warranty states a time window for something we do, that window is the latest we hold ourselves to — and we do our best to beat it. We will keep you updated at each step.

5.9 Returning a whole System. Sections 5.3, 5.4 and 6 govern parts and accessories. Returning an entire System to us is a different matter — it is crated freight — and it requires our authorization in advance. We authorize a whole-System return where the remedies in this Section have been exhausted, on-site technician service included.

So that this is not open-ended, any one of the following automatically qualifies your System for a whole-System return authorization:

  • Two on-site service attempts have failed to remedy the same covered fault; or
  • Your System has been out of service for 35 days or more, in aggregate, for the same covered fault — excluding any period during which we are waiting on information, access or scheduling from you under §5.2; or
  • We determine that on-site repair is not feasible for the fault.

Once a trigger is met, we do our best to decide sooner — and in any event we will give you our decision within five (5) business days. Where a whole-System return is authorized, we arrange the collection and tell you how the System is to be prepared, and we bear the crating and freight cost; Section 4 governs which remedy we then provide.

This authorization gate does not apply to, and never delays, the following — neither is a warranty claim, and neither requires you to exhaust service first:

  • A cancellation or change-of-mind return. Withdrawal, cooling-off and cancellation rights are cancellation rights, not defect claims. They run on their own track under our Shipping, Returns & Refunds terms, and are never conditioned on exhausting service or on our authorization under this Section.
  • A statutory remedy the law lets you choose. Where applicable law gives you the right to elect a refund or a replacement instead of a repair, that election is yours to make, and nothing in this Section requires you to exhaust repair attempts before making it.

5.10 Sealed assemblies. Some parts of your System — including the controller enclosure — are sealed, line-powered assemblies. As §5.4 says, they are not opened by customers, and they are not opened by anyone other than us or a service provider we have approved.

If a sealed assembly has been opened, we will not work on it until we have inspected it and confirmed it is safe to handle and to return to service. We will tell you what that inspection found.

This is a safety requirement and not a limit on your warranty. If the inspection shows the fault is one this warranty covers, it is covered — and we bear the cost of the inspection.

6. Shipping

This Section governs shipping of parts and accessories. A whole-System return is governed by §5.9.

6.1 Sending the part back to us. Where a removed or failed part is to be returned — whether you have fitted a replacement yourself under §5.3, or the component is one that comes to us under §5.4 — we arrange and pay standard carriage, at standard ground or economy service. We book the collection or supply the dispatch arrangement, we pay the carrier directly, and the tracking is visible to both of us. Pack the part as we instruct. You are not asked to pay for the return leg and you are not asked to claim anything back. If you would rather use a faster service than we have arranged, the difference in cost is yours (§6.5). Where an amount is properly chargeable to you, we invoice it afterwards — see §6.4. Sections 5.3 and 5.7 continue to apply.

6.2 On an accepted claim, the part and the carriage cost you nothing. On an accepted warranty claim, we pay standard carriage on the replacement or serviced part and on the return leg, directly to the carrier. Nothing is charged to you and nothing is reimbursed to you, because nothing is taken from you. If you chose a faster service than we arranged, that difference remains at your cost (§6.5).

6.3 Risk of loss on the way back to us. Risk of loss of the returned part passes to us when the carrier takes receipt of it. Use the booking we arrange and keep your collection or drop-off receipt — a shipment we cannot trace is one we cannot accept risk for.

6.4 Where an amount is properly chargeable, we invoice it afterwards. We do not withhold carriage, and we do not make the return leg conditional on the outcome of your claim. We arrange and pay standard carriage in every case under §6.1. Where inspection then shows a chargeable outcome, we invoice the amount afterwards. A chargeable outcome is one of the following, and nothing else:

  • no defect covered by this warranty is found; or
  • the failure resulted from a cause this warranty does not cover (§3); or
  • a part we sent you was not returned to us as §5.7 requires.

Where an amount is invoiced, it is the standard ground or economy carriage we actually paid, and nothing more. Section 5.7 continues to apply to the part itself and to any associated labor.

6.5 Expedited shipping — whoever asks for the speed pays for it.

Where you ask for it, it is at your cost. If you want service faster than standard transit provides, expedited or faster-than-standard carriage is at your cost, in either direction, and that is so whether or not you hold any support or service plan. The carriage we arrange is at standard ground or economy service; if you choose a faster service instead, the difference is yours.

Where we choose it, it is at our cost. If we elect expedited carriage for our own reasons — to meet a service commitment we have made, to clear a backlog, or to keep your service inside a period we work to — that is our commercial choice and our cost, in either direction. Where we ask you to ship at a service level faster than the carriage we arranged, we arrange and pay for the upgraded service. You are never charged for a speed you did not ask for.

6.6 Out of warranty. Where the System or part is outside its warranty period, or the work is not covered by this warranty, carriage in both directions is at your cost and is quoted before any work begins.

7. Selling your System; ownership registration

You may sell or give away your VAVE System at any time. This warranty does not transfer: it is personal to the original purchaser, and coverage ends when ownership of the System transfers. A subsequent owner does not acquire rights under this warranty (their statutory rights, where applicable law grants rights that follow the goods, are unaffected).

If you sell your System, please have the new owner register their ownership with us — free — at support@resonantvibe.com, with the System serial number and their contact details. Ownership registration is not a warranty and creates no coverage; it is how we reach the current owner with safety information, recall notices, and safety-relevant software updates, which we provide to every registered owner regardless of warranty status.

8. Reporting damage and safety issues

Delivery damage. Inspect your System on delivery and report any visible transit damage to support@resonantvibe.com within seven (7) days. We manage carrier claims.

Safety issues. Report any injury, malfunction, or unsafe condition to support@resonantvibe.com promptly. Stop using the System until we advise you.

9. Third-party accessories

Biosensor headbands, headphones, and other third-party products carry their own manufacturers' warranties, which govern those products. Where you purchase them directly from the manufacturer, your agreement is with them. We will help you with a manufacturer claim at no charge.

The headphones supplied with your System are a third-party product, and the same applies to a biosensor headband sold with your System in a bundle. Each is warranted by its manufacturer, and we pass that manufacturer's warranty through to you. We service no claim on the headphones or the headband beyond directing you to the manufacturer and helping you with the claim, as above; a defect in the headphones or the headband is not a defect in the System, and a covered defect in the System stays covered in the usual way.

10. Parts and support availability

Replacement parts, tools, and repair documentation are available in line with our Product Support & Longevity Commitment.

11. Limitations

To the extent permitted by law, any implied warranty — including any implied warranty of merchantability or fitness for a particular purpose — is limited in duration to the applicable warranty period for the component concerned.

To the extent permitted by law, we are not liable for incidental or consequential damages.

Nothing in this warranty excludes, restricts or modifies any guarantee, right or remedy that applicable law gives you and that cannot lawfully be excluded, restricted or modified. Where a term of this warranty conflicts with such a right, that right prevails, and the rest of this warranty continues to apply.

Some states do not allow limitations on how long an implied warranty lasts, or the exclusion of incidental or consequential damages, so these limitations may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
